INFORMATION COLLECTED

 

1.     We collect your personal information in various instances, including when you:

 

1.1   Use Snagg in any manner;

 

1.2   Create a Snagg account;

 

1.3   Post on or share a third-party application or website link to Snagg;

 

1.4   Access Snagg or a Snagg account;

 

1.5   Choose, at your discretion, to upload information to Snagg, including any contacts, profile picture or information, and any other content or    communications;

 

1.6   Submit an enquiry to us;

 

1.7   Communicate with us in any manner and for any reason whatsoever; and/or

 

1.8   Engage with us or other users through Snagg.

 

2.     If you create and/or access a Snagg account or otherwise transact or communicate with us, we may collect and use your personal information. This information may include, without limitation, your full names, your contact details, the password you use to create your Snagg account, your date of birth, your gender, financial information (such as your bank account details), transaction history and details of your visits to or use of Snagg.

 

3.     Take notice that if you access Snagg without providing us with your personal information, we may still gather non-personal information from you, including, without limitation, information regarding your activities and use of Snagg.

 

4.     In some instances it may be compulsory for you to provide us with your personal information, such as when you create a Snagg account; this allows us to make Snagg available to you and to provide our service to you. In other instances providing personal information will be optional. If you do not provide personal information where it is compulsory, we will not be able to provide the associated service or access to you, and where you do not provide your personal information where it is optional, you will not receive the associated benefit.

 

PURPOSE FOR WHICH PERSONAL INFORMATION IS USED

 

5.     We collect or otherwise process your personal information inter alia for the following purposes:

 

5.1   To provide Snagg services to you;

 

5.2   To ensure that you have legal capacity to create a Snagg account;

 

5.3   To increase the specificity of Snagg accounts;

 

5.4   To enable you to use Snagg;

 

5.5   To improve and enhance Snagg and your experience on Snagg;

 

5.6   Marketing, promoting and advertising products to you;

 

5.7   In certain instances to share product performance and purchase information with third-party applications;

 

5.8   To communicate with you in order to provide our services to you, for our internal purposes such as inter alia managing your Snagg account or responding to you if you contact us;

 

5.9   To comply with any legal obligations imposed on us.


  1. Without limiting the generality of the aforesaid, Snagg may use analytics to monitor and analyse traffic to the application and your behaviour while using the application.


7.     We may process personal information:

 

7.1   To provide goods and services to you in terms of an agreement with you or where we wish to conclude an agreement with you;

 

7.2   In order to protect your legitimate interests;

 

7.3   In our legitimate interests;

 

7.4   In the legitimate interests of any other person to whom we may supply your personal information;

 

7.5   To comply with our legal obligations;

 

7.6   If you have provided consent; and/or

 

7.7   If the processing is allowed by law.   

 

RETENTION OF INFORMATION

 

8.     Your personal information will be processed and stored for as long as required for the purpose that it has been collected, pursuant to the provisions of this Privacy Notice and/or for as long as its retention is required by applicable law.

 

9.     Personal information collected for purposes related to the performance of a contract between Snagg and you will be retained while the contract is being performed and personal information collected for any other purpose will be retained for as long as is needed to fulfil that purpose.

 

10.   We may retain personal information for a longer period in instances where you have given consent for such processing and where such consent has not been withdrawn. We may also be required to retain personal information for a longer period when required to do so in the performance of a legal obligation.

 

11.   Where you create a Snagg account and delete such account of your own accord, any personal information uploaded to your account will be deleted.

 

DISCLOSURE AND TRANSFER OF PERSONAL INFORMATION

 

12.   We may use and release your personal information or disclose it to third parties in certain circumstances, including, but not limited to, the following:

 

12.1 If required or authorised to do so be law or a court order;

 

12.2 In order for it to enforce its rights;

 

12.3 In order to obtain information about their products and consumer purchase data and behaviour patterns; and

 

     12.4 In order for it to provide goods or services.

 

13.   Third-parties to whom we may disclose personal information include, but are not limited to, corporate affiliates and partners, third-parties who provide goods and/or services to us, third-parties whose content or materials you import or share onto Snagg, government authorities, organs of state, regulators, courts, tribunals and other law enforcement agencies.

 

14.   Personal information we collect may be transferred to third-party partners and businesses, including, where applicable, online payment and/or storage providers. In such cases, we will take reasonable steps to ensure that such persons have appropriate privacy measures in place.

 

15.   We may transfer personal information we collect to persons in other countries and those countries’ laws might not protect personal information in the same manner or measure as the Republic of South Africa. We will take reasonable steps to ensure that recipients in other countries have appropriate privacy measures in place.

 

16.   We may, from time to time, send marketing and promotional material to you.

 

17.   You may unsubscribe from receiving such information by following the relevant “unsubscribe” link or process in the material or otherwise contact us using our email address.

18.   Snagg may use cookies to collect data in various instances to ensure proper functionality and security, to understand how you interact with Snagg, and to otherwise enhance and improve Snagg.

 

19.   You may disable or decline cookies. However, if this is done, you may not be able to use Snagg properly and certain aspects of the application may not function.

 

SECURITY AND ENCRYPTION

 

20.   We take all reasonable steps to protect and avoid unauthorised access to personal information.

 

YOUR RIGHTS

 

21.   You may exercise certain rights regarding your personal information which we process. Specifically, subject to any applicable laws, you have the following rights:

 

         21.1 The right to access personal information;

 

         21.2 The right to rectify personal information;

 

         21.3 The right to object to the processing of personal information;

 

         21.4 The right to delete personal information; and

        

         21.5 The right to restrict the processing of personal information.

 

22.   We may, in certain instances, legally refuse or decline your request to exercise these rights.

 

23.   In some instances, you may withdraw consent for processing. This withdrawal will have no effect on any lawful processing or personal information prior to such withdrawal.
